TERMS AND CONDITIONS

By entering and using our website you are consenting to the following Terms of Use and the separately posted Privacy Policy. Where actions you take are guided by other specific policies or wording (for example the Terms and Conditions of Sale) we will ensure that this is made clear to you by asking you to tick a box and consent to the relevant terms.

We may amend these terms from time to time so please check these terms to ensure that you understand the terms that will apply at that time.

1. This website is operated by Klayr Hunter Consultant & Apothecary. Terms such as "we", "us", "our", “them” and “they” refer to Klayr Hunter Consultant & Apothecary where they are used in these Terms and Conditions and Privacy Policy. 

2. By purchasing something from our e-commerce store, you agree to be bound by the terms and conditions contained in this document.

3. By entering and using our website you are consenting to the following Terms and Conditions, the separately posted Privacy Policy and Refund Policy.

ONLINE SHOPPING

4. We will take all reasonable care to ensure that the details displayed for a particular item offered for sale are correct at the time when the information was entered onto the system.

5. We may not be able to accept your order due to one or more of the following reasons, or for a reason not listed below:

i) The item you have ordered is out of stock

ii) We cannot authorise your payment or have reasonable grounds to suspect your payment may be fraudulent

iii) There has been a pricing or product description error

iv) There is a system or procurement failure

v) You have failed our customer validation checks

6. When you place an order you will receive an email confirming the details of your order. This email is not confirmation that your order has been accepted by us.

7. Your order will only be accepted by us once your goods have been dispatched.

Klayr Hunter Consultant & Apothecary reserves the right to decline orders for bulk or high value purchases.

DELIVERY

8. All products are sent first class via Royal Mail on Thursday and Friday each week. Where an estimated timescale for delivery is provided, this is an estimate only and your items may be delayed in being received due to circumstances beyond our control (such as a postal delay or at busy times).

9. Where you specially request "next day delivery", orders placed on Fridays, Saturdays or Sundays may not be despatched for delivery until the following Monday and so may not be received until Tuesday.

REFUND POLICY

10. This policy sets out the returns policy for goods or services purchased through the online store operated by Klayr Hunter Consultant & Apothecary.  Terms such as "we", "us" and "our" refer to Klayr Hunter Consultant & Apothecary where they are used in this Refund Policy.

11. All herbal products are non-refundable and non-returnable. Exceptions apply should the item be damaged or faulty. Klayr Hunter Consultant & Apothecary does not accept responsibility for items damaged in the post.

12.  Gift certificates or gift wrapping services are not eligible for a refund.

13. Our standard returns policy entitles you to a full refund of the purchase price and postage and packaging charges if the goods or services provided are faulty or were not described properly within 7 working days.

14. If the item you purchased was faulty or you think the item was not as described in the item description, please contact us first before requesting a refund as we may be able to resolve your problem to your satisfaction.

15. Where you would like to return a physical product you have purchased, please contact us to let us know that you will be returning the item. To obtain a refund for a non-physical product (like a service) please contact us for further information about how this can be done.

16. If eligible, once your return is received and inspected we will contact you to let you know whether your refund will be processed or not, and credit your original method of payment, within 7 days

17. If you haven't received a refund yet where we have told you we have issued one, please check your bank account or card statement to make sure it hasn't been received and then contact your bank as some banks or card companies take a number of days to credit your account.

18. If an item you purchased was purchased with a discount voucher, then we will only refund the amount that you paid (and not the amount the item was listed for).

19. If an item you purchased was in a sale then it may not be eligible for a refund. If you are in any doubt please contact us before making the purchase.

 

ORDER CANCELLATIONS

20. If you wish to cancel an order you have placed you must contact us immediately to ascertain whether the items have been dispatched or not. Where they have been dispatched, you will need to return the item to us and you will be responsible for paying the cost of returning the items.

21. Where items have not been dispatched prior to a cancellation request our refund policy will apply.

22. Where you have ordered a personalised, perishable or time critical item (such as herbal prescription, food, event tickets or e-vouchers) you may not be able to cancel for a full refund.

LIABILITY AND INDEMNITY

23. Klayr Hunter Consultant & Apothecary shall not be liable for any direct, special, indirect or consequential or incidental damages as a result of the use of or the inability to use any items that have been ordered on this website. 

24. Whilst every effort has been taken to ensure that the information provided on this website is correct at the time of writing it is not possible to provide any guarantee of accuracy. Klayr Hunter Consultant & Apothecary does not accept responsibility or liability to any person for loss or damage suffered as a consequence of their placing reliance upon the information. You should make appropriate queries and satisfy yourself before placing any reliance upon or taking any action on such information. By so placing reliance or taking action you accept that you do so at your own risk.

25. You agree to indemnify us and our agents, officers, directors and employees, immediately and on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of any of our terms and conditions.

WEBSITE

26. Any links to third party websites are provided solely for the purpose of your convenience. We have no control over the content of such websites and accordingly make no representation concerning the content of those sites to you nor make endorsement of any of them. We have not tested any content, software features or links found on their sites and do not give any representation regarding their quality, safety, suitability or reliability or any of the material contained in them.  We have no control over said websites and as such cannot be responsible for the protection and privacy of your data or information you provide whilst visiting those sites.

27. All visitors to Klayr Hunter Consultant & Apothecary downloads information from this site at his or her own risk. Klayr Hunter Consultant & Apothecary makes no warranty that downloads are free of corrupting computer codes, including, but not limited to, viruses and worms.

28. Cookies are small files which are placed on your computer's hard drive. Cookies help our website to analyse traffic and visitors and help our site respond to you as an individual.  We use traffic log cookies to identify which pages are being used on our site and analyse visitor behaviour through statistics.

29. At the point of sale you will be passed to a Secure Order Processing page, your details will be encrypted by 128-bit industry-standard Secure Sockets Layer (SSL) technology to provide encryption of personal information such as your name, address and credit card details.  This server encrypts information while it is being transmitted across the Internet so that unauthorised persons are unable to read it.  All payments are taken via Stripe who complies strictly with international data protection laws.

 

UNLAWFUL OR PROHIBITED USE

30. You shall not use this site for any purpose that is unlawful or by any means prohibited under this terms and conditions. You shall not use this site in any manner, which may harm Klayr Hunter Consultant & Apothecary or other parties or adversely affect the site functionality or its use by others. You shall not attempt or obtain from or through this site any information that is not already and intentionally made available from or through it.

 

JURISDICTION

31. Any dispute or claim arising out of or in connection with any purchase of our products or their subject matter or formation (including non-contractual disputes or claims) will be governed by Scots law.

32. These terms and conditions constitute the entire agreement between the parties and supersede any and all preceding and contemporaneous agreements between you and Klayr Hunter Consultant & Apothecary whether written or oral.

GENERAL

33. We may change these terms and conditions at any time.

34. Should any part-term or term be found to be unenforceable then the remainder of the terms and conditions shall continue to have full force and effect as if the invalidated term was not present.

35. Should any delay or failure to comply with our obligations under these terms and conditions arise where it is beyond our reasonable control, we will not be responsible to you for such delay or failure.

36. This website is protected by copyright. Permission is given for the downloading and temporary storage of one or more of these pages for the purpose of viewing on a personal computer, mobile phone, tablet or monitor. The reproduction, permanent storage, or re-transmission of the contents of this website is prohibited without the prior written consent of Klayr Hunter Consultant & Apothecary.

DISCLAIMER

37. The information contained in this website may include opinions or views which, unless expressly stated otherwise, are not those of Klayr Hunter Consultant & Apothecary If anything on this website is construed as being contrary to the laws applicable in any other country, then this website is not intended to be accessed by persons from that country and any persons who are subject to such laws shall not be entitled to purchase our products unless they can satisfy us that such purchase would be lawful.

PRIVACY POLICY FOR ECOMMERCE 

38. We collect only the basic personal details required to process your order and for marketing purposes. We will not release your name, address, email address or any other information about our customers to any outside party. We will not trade, sell, or redistribute any customer information provided, to any other companies, organisations or individuals.

39. You will receive an initial series of welcome emails containing information relevant to your purchase. We may contact you by email, post or sms with offers of additional products, services and information that we think may be of interest to you. If you do not wish us to contact you in this way, please email us at klayr@herbalmedicineglasgow.co.uk and request to be removed from our marketing database.

40. We try to ensure that all data we hold about our customers is up to date and correct. Therefore, if any of your personal details change, please let us know by contacting us at klayr@herbalmedicineglasgow.co.uk.

PRIVACY POLICY FOR REGISTERED PATIENTS

41. When you supply Klayr Hunter Consultant & Apothecary with your personal details they are stored and processed for 4 reasons (the following in bold are the relevant terms used in the Data protection Act 2018, which includes the General Data Protection Regulation):

i)       Klayr Hunter Consultant & Apothecary needs to collect personal information about your health in order to provide you with the best possible treatment.  Your requesting treatment, and Klayr Hunter Consultant & Apothecary’s agreement to provide that care, constitutes a contract.  You can refuse to provide the information, but if you were to do that Klayr Hunter Consultant & Apothecary would not be able to provide treatment.

ii)      Klayr Hunter Consultant & Apothecary has a “Legitimate Interest” in collecting your information, because without it Klayr Hunter Consultant & Apothecary cannot do their job effectively and safely.

iii)     It is important that Klayr Hunter Consultant & Apothecary can contact you in order to confirm your appointments or to update you on matters related to your medical care.  This again constitutes “Legitimate Interest”, but this time it is your legitimate interest.

iv)     Provided Klayr Hunter Consultant & Apothecary has your consent, they may occasionally send you general health information in the form of articles, advice or newsletters.  You may withdraw this consent at any time – just let Klayr Hunter Consultant & Apothecary know by any convenient method.

42. Klayr Hunter Consultant & Apothecary has a legal obligation to retain your records for 8 years after your most recent appointment (or until aged 25, if this is longer), but after this period you can ask them to delete your records if you wish.  Otherwise, Klayr Hunter Consultant & Apothecary may retain your records indefinitely in order that they can continue your care should you need to see her at some future date.

Your records are stored

i)       On paper, in locked filing cabinets, and within a locked building when out of working hours. 

ii)      Electronically (“in the cloud”), using a specialist service.  This provider has given their assurances that they are fully compliant with the General Data Protection Regulations.  Access to this data is password protected, and the passwords are changed regularly.

iii)     On Klayr Hunter Consultant & Apothecary’s office computer.  This is password-protected, backed up regularly, and the office where it is kept are locked out of working hours.

43. Klayr Hunter Consultant & Apothecary will never share your data with anyone who does not require access without your written consent.  

44. If Klayr Hunter Consultant & Apothecary needs to employ a member of staff, for example, to dispense, she will ensure that they sign a non-disclosure agreement and that they must treat all information as confidential.  They will only have access to the parts of your data they require to perform their job.

45. Only the following people/agencies will have routine access to your data:

i)       The cloud service who store and process our files

ii)      Reception staff, if they organise my diary, coordinate appointments and reminders

iii)     Dispensary services if making herbal medicines for you

46. You have the right to see what personal data Klayr Hunter Consultant & Apothecary holds of yours, and you can also ask them to correct any factual errors. Provided the legal minimum period has elapsed, you can also ask them to erase your records.

If you feel that Klayr Hunter Consultant & Apothecary is mishandling your data in some way, you have the right to complain.  Complaints need to be sent to the “Data Controller” which is, Klayr Hunter.  Here are the details you need for that:
